Register Your Reservoir With SEPA From 1 April 2015 To Avoid Charges

Ensuring that reservoirs are correctly managed and maintained is essential. They provide Scotland with drinking water, power, resources for business and social amenities. Reservoir safety in Scotland is currently regulated under the Reservoirs Act 1975 by local authorities and requires operators to register their reservoirs with their local authority.

SEPA logoIn 2011 the Scottish Parliament passed The Reservoirs (Scotland) Act 2011 which, once fully enacted, will replace the 1975 Act. Responsibility for regulating reservoir safety will transfer from local authorities to the Scottish Environment Protection Agency (SEPA). The 2011 Act aims to provide a more proportionate form of regulation for the industry and is consistent with how other sources of potential flooding are assessed.

There will be a phased transition to the 2011 Act and it will be necessary for reservoirs to be registered with SEPA. Registration will open on 1 April 2015 with a six month free registration period before SEPA takes on its full regulatory function in 2016.

Through previous correspondence with local authorities, reservoir managers and engineers, SEPA has collected a significant amount of information on the majority of reservoirs currently regulated. To support reservoir managers in completing the registration process, SEPA will re-supply the information already collected in pre-populated, hard copy registration forms. These forms should be completed by reservoir managers and returned to SEPA.

It is the responsibility of the reservoir manager to register their reservoir(s) with SEPA during the prescribed registration period. Failure to do so would mean missing the free registration period and could result in enforcement action.
